JD – Group Investigation Purpose and context -: As part of the Legal & Compliance, Group Investigations’ purpose is to protect Aviva’s assets and reputation, and to influence sustainable behavioral change, by investigating and reporting on serious alleged breaches of Aviva’s Business Ethics Code by Aviva employees. Group Investigations executes its purpose by, amongst things: (i) triaging and evaluating reports received against its scope of activities; (ii) conducting high quality and efficient investigations; (iii) reporting its investigations findings (including control enhancement observations as appropriate) to management and other stakeholders as required; and (iv) periodic reporting to relevant Boards and Committees, and or any other senior stakeholders as appropriate. Group Investigations is a global function in the Aviva Group working across Aviva’s regions / business units. The role reports into Aviva India’s Head of Legal & Compliance and works under the guidance of the Head of Investigations for Group Investigations. KEY RESPONSIBILITIES: The role has the following key responsibilities: Investigations-:
- Overseeing and leading on investigations in respect of suspected or alleged instances of internal and non-customer malpractice, unethical activity, or financial crime within the Aviva India business.
- Providing quality control to Aviva India investigations to ensure execution and delivery is to the required standard.
- Ensuring the production of objective, concise and high-quality investigation reports.
- Ensuring the appropriate application of, and contributing to the ongoing development of the investigation methodologies, including identifying areas for improvement in the operation of the Investigations team.
- Establish strong stakeholder relationships with Executive and SMG level employees as appropriate to provide regular updates on investigations and to gain a good understanding of the business, the challenges it faces, and the key inherent risks.
- Investigate concerns raised via Aviva’s whistleblowing service, Speak Up, in accordance with Aviva’s Speak Up Charter and investigation methodologies.
- Effective collaboration and close liaison with the Aviva Group Speak Up team, including the promotion of the Speak Up service within Aviva India.
- Ensuring the production of concise and high-quality Board / Committee reports, tailored for the audience.
- Perioding reporting of relevant issues/matters to local management, Aviva group, and Audit /Risk / Governance Committees, as appropriate to enable them to discharge their duties, including (but not limited to) managing risk and delivering an effective controls framework.
- Liaise closely with colleagues in the 1st and 2nd line Financial Crime / Risk / Data Analytics teams who proactively identify areas of internal and non-customer malpractice or financial crime.
- Provide insight and expertise with respect to the financial crime risks the business is exposed to and any potential control weaknesses.
- Performance management for assigned members of the Aviva India Investigation team.
- Managing optimum utilization of the team.
- Extensive experience in leading and executing on investigation work, financial crime, forensic accounting or audit in financial services or regulation institution. Good knowledge of financial / risk / insurance / asset management market related topics.
- Experience in leading complex projects/reviews, leading small-medium multi-location, multi-cultural teams and negotiation situations.
- Experience in managing the senior level relationships and influencing their behavior and dealing with Senior Management in potentially sensitive situations.
- Proven experience in managing a team and effective people management.
- Degree and professional qualification preferred.
- Professional fraud investigation or financial crime qualification (ACFS, CFE or equivalent) preferred.
- Evidence gathering and interviewing skills (suspect and witness).
- Reporting skills.
- Technical Insurance / asset management product / market knowledge
- Risk management expertise.
- Data analytics skills
- Forensic Accounting (basic knowledge / experience preferred).
- Specialist, current and in-depth knowledge of all aspects of investigation principles and financial crime.
- In depth technical knowledge of fraud investigation techniques, employment law and legal requirements.
- Thorough understanding of local legislation impacting internal investigations and whistleblowing reports.
- Leads by example by making ethical decisions, including those that respect Aviva’s core values (Care, Confidence, Community & Commitment).
- Thorough knowledge of local legislative and regulatory environment.
- Good understanding of financial crime regimes in other countries in which Aviva operates.
- Experience of acting as expert witness or giving evidence in Court.
- Experience of IT forensics and statistical analysis of financial crime data.
- Broad understanding of local asset recovery processes.
- Knowledge of best practice in forensics, financial crime prevention, internal auditing, project and change management.
