IN THE LAHORE HIG H COURT, RAWA LPINDI BENCH, RAWALPINDI W.P No. _______/2020 Farhan Yaseen son of Mehmood Alamresident of House No. 1, Street No. 1, MohallahShah Chan Chirgah, Rawalpindi Versus Deputy Commissioner, Rawalpindi WRIT PETITION UNDERARTICLE 199 OF CONSTITUTION OF ISLAMIC REPUBLIC OF PAKSITAN , 1973 Respectfully Sheweth: 1. That the facts in brief leading to the filingof the instant Writ Petition are that the petitioner has been running Hotel inthe name of "Farhan Hotel",at Lower Bazar, Murree, Tehsil Murree,District Rawalpindi since long. 2. That in the year 2009 the Government ofPunjab announced to provide Sasti Roti at the rate of Rs. 2/- per Roti to thepublic under "Sasti Roti Scheme". 3. That the petitioner's hotel was enlisted/ registeredfor providing Sasti Roti Sasti Roti Scheme and the Government of Punjabprovided the subsidized Atta to the petitioner thus the petitioner startedproviding Sasti Roti to the public. 4. That later on, it became very difficult forthe petitioner and other Tandoor owners enlisted with Government of Punjab, toprovide Sasti Roti to the public @ Rs. 2/- Per Roti because of so many expensesin this regard like utility bills, labour, shop rent etc. 5. That due to the hardships which were beingfaced by the petitioner and other enlisted Tandoor Owners, the Petitioner'sAssociation "Nan Bi Association" District Rawalpindi submitted an application on25-09-2009 to the DCO, Rawalpindi for redressal of their grievances asmentioned in para No. 4 of this writ petition, thereafter matterwas settled on 12-10-2009 between the "Nan BiAssociation" District Rawalpindi" and Government of Punjab through Deputy DistrictOfficer (Tehsildar) Murree, in which the Government made assurance to redressthe grievances of the "Nan Bi Association" 6. That on the assurance made by the Governmentof Punjab as stated above,the petitioner kept on providing Sasti Roti to the public @ Rs. 2/- per Rotitill 2012. It is pertinent to mention here that all the expenses were paid bythe petitioner from his own pocket but despite of assurance made by the Governmentof Punjab, it did not redress the grievances of the "Nan Bi Association"including petitioner. 7. That a number of applications were filed bythe petitioner for recovery of expenses incurred by thepetitioner on the said scheme but till date,the petitioner has not been compensated. Lastly, the petitioner filed an applicationbefore Honourable Prime Minister of Pakistan for the redressal of the grievancewhich was forwarded to the respondent by the Prime Ministers Public Affairs andGrievances Wings, Ministry of Parliamentary Affairs, Cabinet Block, Islamabad videletter No. P A&GW/2018/Punjab-II/24017/115635. 8. That the respondent's office forwarded thematter to Assistant Commissioner Murree. The ACMurree after receiving letter from the respondent, entrusted the case ofpetitioner to concerned Halqa Patwari whosubmitted his report on 04-11-2019 in favour of the petitionerbefore the office of Assistant Commissioner, Murree. The AC Murreeforwarded the same to respondent for the decision of compensation,which is still pending before the respondent. The petitioner many timesrequested the respondent for the disposal of application but the respondent didnot pay any heed on the request of the petitioner, hence this writ petition. 9. That the fundamental rights of petitioneras enshrined in the Constitution of Islamic Republic of Pakistan have been infringed. 10. That the petitioner has been left with noother option but to knock the door of this Honourable Court by way of filingthe instant writ petition. PRAYER It is most respectfullyprayed that the instant Writ Petition may graciously be allowed, and the respondentbe directed to decide the application ofpetitioner for compensation without any delayand to grant compensation for the expenses incurred by the petitioner onthe "Sasti Roti Scheme" Any other relief which this Honourable Court deems justand proper, may graciously be extended in favour of the petitioner, to meet theends of justice.
