This role will report to the ABB Motion Regional General Counsel for North America in Milwaukee, Wisconsin. The position will be based in Montreal, and the successful candidate will be expected to work from the office in Montreal on a regular basis. Some travel, including outside of Canada, may be required.Your responsibilitiesAct as Business Partner to the Motion Canada Business, whilst maintaining an independent position.Develop close working relationships with ABB internal customers including commercial business teams, finance, HR, EHS, and supply chain functions.Develop contract strategy based on customer requirements, ABB policies, and the overall execution strategy considering risk, pricing, scope, and schedule.Draft and negotiate commercial contracts with customers and suppliers for the Motion Canada Business, as well as frame agreements on a global level or between multiple Business Areas.Collaborate with other Legal Counsels in the development of contract standards, templates, and guidelines and ensure their implementation and operationalization within Canada.Provide training and guidance to the Motion Canada Business.Develop and implement risk mitigation and opportunity plans together with the local Project Manager and/or Sales Manager.Ensure that relevant (sub) contracts contain appropriate contract terms and conditions to protect ABB's interest, including flow-down of main contract terms. Provide general guidance and management of legal issues in respect of competition laws, labor and employment laws, privacy and data protection including GDPR, product liability and warranty claims, and other legal matters that arise within the business in collaboration with other members of the global ABB legal team and internal and external subject matter experts.Support in managing contractual claims and advise on the resolution of disputes or litigation through external advisors when necessary.Support our business with other general legal advice and questions related to integrity; may assist in investigation and resolution of any integrity issues that arise. Be an active member of the Motion North America and global legal team and assist with other legal matters and projects as assigned.Your backgroundLaw degree LLB (Canada).Member of Quebec Bar or member of another Canadian province Bar.Common law diploma or strong common law experience.3-7+ years post qualification experience practicing commercial law, either as a private practice associate or as an in-house legal counsel. Fluency in English and French with strong communication, presentation and networking skills is a must.Strong drafting and negotiation skills and ability to work in a complex international environment.Having experience in similar industry would be an advantage.A U.S. bar membership or cross-training and experience with US law would be an advantage.Ability to work independently with limited supervision is required.Must be well-organized and able to manage multiple assignments simultaneously under deadline pressure.Experience with projects related contracts, distribution/partner agreements, intellectual property, and data privacy is highly desired.Candidates with a practical mind-set, who have a proactive "hands-on" attitude, exposure to cross country collaboration, and experience in a multicultural environment are desired.The capability to be flexible and adaptable in a changing and challenging environment and think 'out of the box' when unexpected/unplanned events arise, together with the capacity to solve practical problems and deal with a variety of concrete variables within a robust compliance framework where only limited standardization may exist, will be a key to success in this role.BenefitsRetirement planAccident insuranceHealthcare planWellbeing programMore about usWe look forward to receiving your application.
